The Prefecture: Extinction or constitutional reincorporation in the bicentennial of creation

Peru in the bicentennial has debated the imminent extinction of the political-legal entity “Prefecture” in the face of the proposal - controversial and countercurrent - of subsistence in its bicentennial precisely on its constitutional reincorporation as a possibility of becoming an adequate channel for citizen demand, which articulate the three levels of government and contribute to governance effectively. It is based on a historical description of the previous regulatory framework, debates and sources of the Constitution of 1823 that incorporated the Prefecture as the main axis of government in the interior of the country. Likewise, we develop the transition of this entity in the 19th and 20th centuries until its episodic withdrawal from the 1979 Constitution. Finally, the current role of the Prefecture and its coexistence with the three levels of government are described, the proposal for its Constitutional reincorporation is raised, and the current political context of decentralization is analyzed. recognizing the current trend that would justify the extinction of the Prefecture.
