Editorial ethics policy

Lucerna Iuris et Investigatio adheres to and is guided by the standards and codes of ethics of the Committee on Publication Ethics (COPE) [http://publicationethics.org/], the Principles of transparency and good practices in academic publication declaration (http://publicationethics.org/resources/guidelines-new/principles-transparency-and-best-practice-scholarly-publishing); as well as the Peruvian regulations referring to scientific research, legal regulations on copyright, open access, the Lawyer's Code of Ethics (https://www.gob.pe/institucion/minjus/informes-publicaciones/363238-codigo -de-etica-del-attorney) and others related to the topics of our magazine.

Bad behaviours and plagiarism

Lucerna Iuris et Investigatio considers fraud and misconduct such as manufacturing (invention of data or results), falsification (manipulation of research materials, equipment, processes to alter data or results, as well as change or omission of data or results) and duplication of publications (publication of a work in several journals or media). As a category of duplication, self-plagiarism is considered, which consists of the use of texts used in other works by the same author, losing originality in the work presented to the journal, self-plagiarism is also known as recycling of texts.

Lucerna Iuris et Investigatio considers plagiarism as fraud in publication and behaviours of academic dishonesty, and is defined as the appropriation of the ideas, processes, results or words of another person without giving the corresponding credit.

Lucerna Iuris et Investigatio does not tolerate plagiarism, fraud, or misconduct, which is why it establishes mechanisms to prevent and remedy it: (a) During the editorial process, Lucerna Iuris et Investigatio uses the Turnitin software to detect them. (b) After its publication, if Lucerna Iuris et Investigatio detects or is alerted and confirms cases of plagiarism, fraud or misconduct, it will proceed according to the guidelines and recommendations of the Committee on Publication Ethics (COPE - http://publicationethics.org/ ) being able to execute the retraction of the article. The percentage of textual similarities of the Turnitin software should not exceed 10%, including recycled texts (self-plagiarism).

Authorship

All authors of a manuscript must agree to its submission to the journal. Lucerna Iuris et Investigatio adheres to the definition of author created by the International Committee of Medical Editors (ICMJE). According to ICMJE, the authorship criteria must be based on:

  • substantial contributions to the conception and design or acquisition of data or analysis and interpretation of data,
  • writing the draft of the article or critical review of its important intellectual content,
  • approval of the version to be published and
  • Agreement to be responsible for all aspects of the job. Authors must comply with all conditions.

All authors must be accredited when submitting the manuscript, those who do not qualify as authors must be mentioned in the acknowledgments. Authorship problems during the process (insertion or separation of an author, claims for location) can lead to withdraw the work from the editing process.

Conflict of interest and funding sources

Authors must declare the origin of any financial aid received. There is a conflict of interest when the author (authors) had or has financial or personal relationships that may have biased or improperly influence their actions. In this case, they should be indicated when the relationship (direct or indirect) is about the work that the authors describe in their manuscript. Potential sources of conflicts of interest can be being a member of the board of directors of a company related to the research, being a member of an advisory council or consulting committee of companies and the receipt of fees from a company involved in the study. The existence of a conflict of interest does not prevent the publication of the article in the journal. All authors of the work must present a statement in the cover letter that includes this aspect and include it at the time of submission of the manuscript. The declaration of conflicts of interest should be written in a paragraph at the level of the first page.

Permissions

Authors are responsible for obtaining permission to partially reproduce material (text, tables, or figures) from other publications. These permissions must be requested from both the author and the Editorial that has published said material and the institution that has funded the research and must be attached in the submission of the manuscript. Additionally, the authors must include a statement that the content of the article is original and that It has not been previously published nor is it sent or submitted for consideration to any other publication, whether in whole or in part. Failure to disclose this information constitutes a serious breach of ethics. The information presented within the manuscripts must have originality, the journal reserves the right to reject manuscripts when paragraphs and / or plagiarized information are found without the consent of another author and / or institution.
